White House spokesman Raj Shah released a statement saying that Senate Minority Leader Chuck Schumer and Senator Dianne Feinstein have ignored White House requests to meet with Kavanaugh for over three weeks. “While we look forward to potential meetings,” the statement says, “both of these Democratic senators and many of their colleagues have publicly opposed Judge Kavanaugh’s nomination.” Despite refusing to meet with Kavanaugh, Schumer criticized Republicans for “cast[ing] aside Democratic wished for openness and transparency and has made a partisan request for only a small subset for Judge Kavanaugh’s records.” Schumer also questioned, “What are the Republicans hiding about Judge Kavanaugh’s record?” The Senate Judiciary Committee has already been provided 300 judicial opinions and over 130,000 pages. Shah claims that the Democrats are “disingenuously” demanding “ millions of pages of documents from former President Bush that are irrelevant to evaluating Kavanaugh's thinking. “[T]he Administration continues working to provide access to more documents and records pertaining to Judge Kavanaugh’s record than any Supreme Court nominee in U.S. history,” the statement concludes. Earlier this week, Senator Rand Paul announced his intentions to support Kavanaugh after taking a meeting with him that was over an hour long.

dailycaller.com/2018/08/10/date-brett-kavanaugh-hearings/Supreme Court nominee Judge Brett Kavanaugh’s first confirmation hearing is set for Sept. 4, said Republican Iowa Sen. Chuck Grassley, chairman of the Senate Judiciary Committee, Friday. The date is in line with Republicans’ desire to confirm Kavanaugh, who was picked by President Donald Trump, by early October when the Supreme Court starts a new term, reported Politico. “He’s a mainstream judge,” Grassley said in a statement according to The Hill. “He has a record of judicial independence and applying the law as it is written. … It’s time for the American people to hear directly from Judge Kavanaugh at his public hearing.” The three to four days of hearings will likely occur “before the National Archives is able to fulfill Grassley’s request for documents from Kavanaugh’s time as a White House lawyer,” reported The Hill. However, a separate legal team has already said it will be able to fulfill the request at a quicker pace. “If we could get this all done by Oct. 1 when the Supreme Court starts its new fall session, [that] would be ideal,” Grassley said on conservative radio host Hugh Hewitt’s show on Aug. 1. “But I think we can get it done soon after that if we don’t get it done by Oct. 1.” (RELATED: This Is The Timeline For The Kavanaugh Confirmation) Conservatives defended Grassley’s announcement of the timeline. “Democrats have already announced that they oppose [Kavanaugh], so this claim that they need more time or more documents is nothing more than a show,” said Carrie Severino of the Judicial Crisis Network. “Judge Kavanaugh has been endorsed by leading figures on the right and the left. He is a mainstream nominee who will base his decisions on the law and the Constitution.”

www.nationalreview.com/news/mitch-mcconnell-declares-end-to-obstruction-trump-nominees/Senate majority leader Mitch McConnell has taken his hardest line yet in the face of what he called Democratic “obstruction” of Trump administration nominees to the judicial and executive branches. McConnell on Thursday announced that the Senate will stay in session for as long as it takes to approve twelve of Trump’s judicial nominees as well as four executive-branch picks. “No more obstruction, no more delays. It’s time to confirm them all,” McConnell said. “The Senate will continue to work right through August until every single one of them is confirmed.” McConnell plans to explode Democratic filibusters on every one of the next 16 nominees, and has scheduled votes on them for this week. Democrats’ own 2013 amending of the filibuster rule has prevented them from stopping the votes. Former Senate majority leader Harry Reid spearheaded the effort to cancel the filibuster option for most nominations by presidents. Instead of the 60-vote supermajority previously required to confirm administration nominees, the razor-thin Republican majority can confirm them with zero Democratic votes. So far 110 Trump nominees have had to deal with a filibuster threat from Democrats, McConnell said on Twitter.

www.dailywire.com/news/35031/democratic-sen-dianne-feinstein-pens-wildly-frank-camp?ampDemocratic Sen. Dianne Feinstein Pens Wildly Misleading Tweet About SCOTUS Pick Brett Kavanaugh On Friday, Senator Dianne Feinstein (D-CA) sent out the following tweet about President Trump’s SCOTUS Nominee Brett Kavanagh: Sen Dianne Feinstein ✔ @senfeinstein The president's Supreme Court nominee has said sitting presidents can NOT be prosecuted, should NOT be investigated, and should have the authority to fire a special counsel AT WILL. With the president facing serious legal jeopardy, the nomination should not be moving forward. 3:06 PM - Aug 24, 2018 51.6K 22.2K people are talking about this Feinstein’s first contention, that Kavanaugh "has said that sitting presidents can NOT be prosecuted" and "should NOT be investigated," is wildly misleading. In 2009, Kavanaugh penned a piece for the Minnesota Law Review in which he stated, speaking first about former President Clinton: www.politico.com/f/?id=00000164-89c2-d96d-a564-99c358430000It must be noted that Kavanaugh is not advocating that the Supreme Court do anything. He is stating that it would be "appropriate for Congress to enact" legislation which would defer criminal and civil suits until after a president leaves office. Moreover, he states that the Constitution already "establishes a clear mechanism to deter executive malfeasance." This process is called impeachment. The power to bring impeachment charges against the president is expressly assigned to the House of Representatives in Article I, Section 2, Clause 5 of the United States Constitution. The power to convict on those charges is expressly assigned to the Senate in Article I, Section 3, Clause 6. Article I, Section 3, Clause 7 then states: "Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of Honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law." During a 1998 panel regarding the Independent Counsel Statute, which expired in 1999, Kavanaugh stated a similar position: www.c-span.org/video/?101056-1/independent-counsel-statute-future&start=3586

www.dailywire.com/news/35296/democrats-call-nixon-lawyer-john-dean-kavanaugh-joseph-curlDemocrats realize that something extraordinary would have to happen for President Trump's nominee to the Supreme Court to be rejected by the GOP-controlled Senate. So, they've decided to pull out all the stops and at least dirty him up, like they did Justice Clarence Thomas. Sen. Dianne Feinstein, the top Democrat on the panel, announced late Thursday that Democrats on the Judiciary Committee have asked John Dean, the White House counsel for President Nixon during the Watergate scandal, to speak "about the abuse of executive power."Trump's nominee, Brett Kavanaugh, has been castigated by Democrats, who reject his view that a president cannot be investigated by a special counsel or held liable for criminal activity while in office. They've demanded millions of documents from his tenure as a staff secretary for President George W. Bush’s White House, even threatening to sue the National Archives to get them. Liberal political pundits have dug deep to compare the current investigation into whether Trump associates colluded with Russia during the 2016 election to Watergate. Dean, who was deeply involved in the Watergate scandal, flipped on Nixon and cooperated with Senate Watergate investigators. Dean was fired by Nixon, then testified against him after being granted immunity. Dean eventually pleaded guilty to obstruction of justice and to supervising payments of "hush money" to the Watergate burglars. He served four months in prison and was disbarred. Democrats say after the conviction of former Trump campaign chairman Paul Manafort and the guilty plea by Trump's longtime former lawyer Michael Cohen, the Kavanaugh hearings should be delayed. "Given the possibility of criminal wrongdoing by the president, doubts that Judge Kavanaugh believes a president can even be investigated, and the unprecedented lack of transparency regarding this nominee’s record, we should not move forward with hearings on September 4th," Democratic senators wrote last Friday.

dailycaller.com/2018/09/03/klobuchar-regrets-nuclear-option/Democratic Sen. Amy Klobuchar of Minnesota said Sunday that her party should not have invoked the so-called nuclear option and abolished the legislative filibuster for judicial nominees. The remarks come just before Judge Brett Kavanaugh will appear for confirmation hearings before the Senate Judiciary Committee. Republican lawmakers expect Kavanaugh will be confirmed if he acquits himself well at the hearings. “I would’ve liked to see 60 votes, no matter what the judge is,” Klobuchar told NBC. “I don’t think we should’ve made that change, when we look back at it. But it happened because we were so frustrated, because President Obama wasn’t able to get his nominees.” But Klobuchar added that neither party is likely to reimpose the filibuster over judicial nominations, since doing so would cede a huge tactical advantage. “I don’t think anyone’s going to want to hamstring themselves,” she said. (RELATED: Kavanaugh’s Most Sensitive White House Records Will Be Withheld, And Democrats Aren’t Happy) Democrats changed Senate rules in 2013 after a protracted Republican filibuster blocked three Obama nominees to the U.S. Court of Appeals for the D.C. Circuit, the court on which Kavanaugh sits. All three nominees, Judges Nina Pillard, Patricia Millett and Robert Wilkins, were later confirmed.
