The senator predicted a ruling against the City would inflame progressive efforts to pack the high court.
Democratic Sen. Sheldon Whitehouse of Rhode Island filed a legal brief before the Supreme Court in a challenge to New York City’s gun transportation regulations, advancing a broad indictment of the Roberts Court itself as he urged the justices to turn away the NRA-backed case. The brief, which follows back-to-back mass shootings in El Paso, Texas and Dayton, Ohio, accuses the justices of delivering partisan decisions for monied Republican interests while warning of lasting damage to the Supreme Court’s legitimacy. The Supreme Court is not well. And the people know it. Perhaps the Court can heal itself before the public demands it be ‘restructured in order to reduce the influence of politics,'” Whitehouse wrote, alluding to court-packing measures that have gained traction in progressive circles. “Particularly on the urgent issue of gun control, a nation desperately needs it to heal.” The case pertains to an ordinance, since amended, regulating gun transportation in New York City. The ordinance authorized licensed gun owners to carry firearms to and from gun ranges, and forbade the removal of firearms from city limits. The plaintiffs are city residents who wish to transport their firearms to vacation homes for self-defense and to shooting competitions outside the five boroughs. Though a trial judge and the 2nd U.S. Circuit Court of Appeals upheld the ordinance, the Supreme Court agreed to hear the dispute in January. Thereafter, the city amended its ordinance and asked the justices to dismiss the case as moot, saying the new rules give the plaintiffs everything they sought in court. The Whitehouse brief urges the Court to follow that course, saying separation of powers principles restrict the courts to deciding real and ongoing controversies, not abstract questions. Yet Whitehouse believes the contemporary Supreme Court has ignored those concepts and abandoned neutral procedural rules to deliver victories for conservative political interests. He claimed the Court employs several methods to circumvent those safeguards, like stealth-overruling precedents — in which the justices refuse to extend past cases to new contexts — or using subtle language to encourage litigants and influence future cases. The 2018 Janus decision is a case in point in Whitehouse’s view. Janus involved a First Amendment challenge to so-called agency fees non-union members paid to organized labor for collective bargaining. The Supreme Court authorized those mandatory dues in a 1977 case called Abood. Long a pet peeve of right-leaning jurists, the conservative justices criticized Abood in a pair of cases from 2012 and 2014, effectively inviting lawsuits against agency fee arrangements. By the time the Court agreed to hear the Janus case, the outcome was something like a fait accompli. “Obviously, the Court is not standing back in dispassionate form and ‘calling balls and strikes’ when it is laying the groundwork for future policy changes or soliciting opportunities to change policy,” Whitehouse wrote, in reference to the chief justice’s famous comparison of judges to umpires during his 2005 confirmation hearing for the Supreme Court. (RELATED: Second Amendment Cases Loom Over Supreme Court After Back-To-Back Massacres) The NRA is supporting the New York plaintiffs. Whitehouse connected their support to NRA political activities surrounding Justice Brett Kavanaugh’s confirmation. The organization spent $1.2 million on television advertising promoting Kavanaugh as a pro-gun tie-breaker in Second Amendment cases. With Kavanaugh confirmed, Whitehouse accused the NRA and its affiliates of waging “an industrial-strength influence campaign” against the Court with a torrent of pro-gun amicus briefs. All told, Whitehouse said the “explosion” of strategic litigation supported by right-wing legal groups with common funding sources was dangerous to the judiciary. Democratic Sens. Dick Durbin of Illinois, Kirsten Gillibrand of New York, Richard Blumenthal of Connecticut, and Mazie Hirono of Hawaii also supported Whitehouse’s amicus brief. Jordan was trying to protect her young son while Andre was trying to shield both of them. Paul was left with broken fingers. After the massacre, Trump visited El Paso, where he met with members of the Anchondo family, including Paul's uncle Tito Anchondo, who is a Trump supporter, as was his brother Andre. Tito Anchondo had told National Public Radio, "I want to see his reaction in person. I want to see if he's genuine and see if my political views are right or wrong and see if he feels maybe some kind of remorse for statements that he's made." While Trump was there, a photo was taken of first lady Melania holding Paul Anchondo as President Trump smiled; Tito Anchondo was in that photo. Jordan's grandfather, John Jamrowski, said the hospital had informed him that President Trump was coming; he said he wanted to avoid making a political statement if he declined to meet with the president. He asserted, "We're politically neutral. We discussed it as a family and said, 'You know what, this could be spun around.'" Tito Anchondo said that after the photo was posted he received death threats, according to The Daily Mail. However, Obamacare state exchanges faced significant challenges for Americans that do not qualify for the Obamacare advance premium tax credit (APTC) and must pay the entire health insurance premium themselves. One study found that, between 2016 and 2018, 2.5 million Americans without Obamacare subsidies left the exchanges, which represents a 40 percent drop. Administrator Verma said that the current exodus proves that Obamacare’s premiums remain too expensive for millions of Americans. “As President Trump predicted, people are fleeing the individual market. Obamacare is failing the American people, and the ongoing exodus of the unsubsidized population from the market proves that Obamacare’s sky-high premiums are unaffordable,” said Verma in a statement Monday. The CMS’s Subsidized and Unsubsidized Enrollment Report showcases that the Obamacare exchanges continue to price Americans out of the individual health insurance markets. In 2017, 1.3 million unsubsidized Americans left the exchanges, while another 1.2 million left the market in 2018. Both of these enrollment declines coincide with increases of average monthly premium increases of 21 percent in2017 and 26 percent in 2018. Americans began to leave the Obamacare exchanges starting in the 2015 to 2016 period for unsubsidized American enrollees. Further, 43 states saw decreases in unsubsidized enrollment from 2016 to 2017, and 47 states saw a decline from 2017 to 2018. In 2018, nine states, including Iowa, Georgia, Nebraska, Tennessee, Virginia, Kentucky, Missouri, Kansas, and West Virginia, lost more 40 percent of their unsubsidized enrollment. While Obamacare remains too expensive for many Americans, the Trump administration has pursued healthcare reforms that would offer Americans more affordable alternatives to Obamacare. The White House released a rule in June that would expand health reimbursement accounts (HRAs) that would allow small businesses to offer health insurance to their employees. The administration estimates that up to 800,000 employers, and more than 11 million workers and family members, will benefit from the healthcare expansion. The Trump administration also expanded short-term health insurance plans. The Foundation for Government Accountability (FGA) study found that short-term plans could cost 80 percent less than Obamacare “bronze” plans. Trump’s latest healthcare reform arises as he promised Republicans will become the party of “health care” and that the White House reportedly will release their health care plan in September.

Lawns are contributing to pollution and climate change, asserts narrator David Botti, and their origins are far from woke, in a seven-minute video on the history of American lawns. Botti says lawns are part of the “colonizing of America,” which transformed the landscape from “pristine wilderness” to “identical rows of manicured nature.” “These lawns come on the backs of slaves,” he continues, zooming in on a painting of George Washington in a field to highlight men cutting the grass with scythes. “It’s grueling, endless work.” “By the 1870s we also see American culture slowly start to embrace lawns for the privileged masses,” he states. The video explains that the perfect lawn is associated with being a model citizen, how the first sprinkler was invented in 1871, and about the advent of “so-called trade cards” that “advertised the hell out of lawn and garden products.” The Times also refers to the work of historian Ted Steinberg, who calls lawns the “outdoor expression of ’50s conformism.” To drive home the point, he inserts vintage footage of two women being interviewed in their yards talking about how they moved to their communities to live exclusively near other white people. Neither of them says anything about desiring, having, or maintaining a lawn. Jenkins’ book concludes that lawns in America are status symbols, and their popularity grew due to promotion by the garden and golf industries and the federal government’s United States Department of Agriculture. She also said that lawns “are a symbol of man’s control of, or superiority, over his environment.” Both Steinberg and Jenkins make the case that lawns are harming the environment. “Steinberg makes a convincing case that ‘turf hysteria” and the “giant chemical orgy’ of modern lawn care have led to water pollution and the shunning of native plants,” one review of his book says. The Times links to a 2005 report from NASA that said there are more lawns in the United States than irrigated cornfields and attempting to quantify how much water is used keeping lawns alive in many areas of the country. The article also includes the Times’ vintage reporting on President Theodore Roosevelt mowing his lawn in 1914. “Col. Roosevelt refused to discuss politics today,” the article on the Times front page said and is shown in the video. “He got in a lot of good, vigorous exercise.
